Alcohol Rules
No open containers. Anywhere public. The beach, the boardwalk, and every public street in the city limits. This is the rule most visitors get wrong and most citations are written for.
Delaware law and Rehoboth Beach ordinance prohibit open containers of alcohol on the beach, on the boardwalk, and on any public street within the city limits. This applies to everyone — any age, any drink, any container. That cup of wine walking down Rehoboth Avenue to the boardwalk is illegal. The beer in your hand on the beach is illegal. The bottle of seltzer that’s actually vodka is still illegal and officers know the difference.
Open container citations are written regularly during peak season. Senior Week enforcement specifically targets this. Alcohol stays in private spaces: your rental house, a restaurant with a liquor license, a licensed bar or hotel.

Smoking and Marijuana
Rehoboth Beach is effectively smoke-free. The beach, boardwalk, dune crossings, parks, playgrounds — all designated smoke-free. And yes, that includes marijuana in 2026.
Marijuana — The 2026 Reality
Delaware legalized recreational marijuana for adults 21+ in 2023. Many visitors assume this means they can smoke or use marijuana freely at the beach. They cannot. Delaware law prohibits marijuana consumption in all public places — including the beach, boardwalk, and any outdoor public space. Smoking marijuana at Rehoboth Beach is illegal and actively enforced in 2026. Marijuana can be legally consumed in private residences only.
The misconception that gets people cited: “Delaware legalized marijuana so I can smoke it anywhere.” This is wrong. Legal to own, legal to use in private — illegal in all public spaces. The beach is a public space.
Beach Rules
Umbrellas
Maximum pole height 7 feet 6 inches. Maximum shade diameter 8 feet. Standard beach umbrellas are fine. The oversized market umbrellas popular at some beaches are not permitted at Rehoboth.
No Tents or Canopies
Tents, canopies, cabanas, tarps, sportsbrellas — all prohibited. The only exception is baby tents no larger than 3 feet high, 3 feet long, and 4 feet wide.
No Glass Containers
No glass bottles or containers of any kind on the beach. Plastic and aluminum only. Enforcement is real — broken glass on a beach is a serious safety issue and the rule is treated accordingly.
No Fires or Grills
Absolutely no fires, bonfires, fire pits, grills, or cooking surfaces of any kind. No exceptions. This includes portable propane grills and charcoal.
No Feeding Seagulls
Prohibited. Within minutes you’re surrounded by dozens of aggressive birds. The rule exists for good reason and is enforced.
Boardwalk Rules
- Bikes: Permitted only between 5am and 10am in summer. After 10am pedestrian only. Strictly enforced.
- No roller skating or rollerblading: Prohibited on the boardwalk and Rehoboth Avenue. Year-round.
- No alcohol: The open container prohibition applies fully. No drinking on the boardwalk regardless of age.
- No smoking: The boardwalk is a designated smoke-free area. Includes tobacco and marijuana.
- No sleeping under the boardwalk: Prohibited. Enforced year-round.
- No changing clothes: On the boardwalk, under the boardwalk, or in vehicles parked on public streets. Use your rental or designated changing areas.
Swimming Rules
Swimming at Rehoboth Beach is permitted only when lifeguards are on duty. After lifeguard hours, swimming is prohibited — not discouraged, prohibited. The beach is closed between 1am and 5am. Lifeguards are typically on duty 10am to 5:30pm daily during summer — confirm on arrival. A red flag means no swimming. Respect it.
This rule is not bureaucratic caution. The Atlantic at Rehoboth has real currents, real waves, and real rip tide potential. Night swimming with impaired judgment is the combination that produces tragedies. Follow it.
DUI Laws at the Delaware Beaches

Most people at the Delaware beaches are from Maryland, Virginia, Pennsylvania, or DC. A Delaware DUI conviction follows you home — your home state receives notification and applies its own penalties on top of Delaware’s. Two states, two sets of consequences, one permanent record.
The legal BAC limit is 0.08% for adults 21+. Under 21: 0.02% — effectively zero tolerance, less than one drink. Golf carts on public roads are subject to the same DUI laws as cars. Sitting in a parked car with keys in the ignition can constitute DUI under Delaware’s “actual physical control” standard.

Nude Beaches Near Rehoboth
Delaware does not have officially state-designated nude beaches. What exists is a long-established de facto clothing-optional tradition at two specific locations that has been tolerated for decades — Delaware Seashore State Park between Dewey Beach and Bethany, and Fenwick Island State Park further south near the Maryland border.
Both operate on tolerance rather than legal designation. No signs. No official permission. The crowd self-selects in the more remote sections away from the main lifeguarded areas. Go informed, be respectful, understand the legal reality before you go.
